1. INFORMATION TO THE USER

Who is responsible for the processing of your personal data?

MONTSERRALT, S.L. will be responsible for the processing of the personal data of those PERSONS who have proceeded to create a profile on any of its social networks, and the same will be treated in accordance with the provisions of Regulation (EU) 2016/679, of April 27 (GDPR), Organic Law 3/2018, of December 5 (LOPDGDD), and the Law on Information Society Services and Electronic Commerce (LSSI), providing the following information on the processing:

For what purpose do we process your personal data?

Purpose of processing: to maintain a relationship between the USER and MONTSERRALT, S.L. (hereinafter, the CONTROLLER) which may include the following operations:

  • Processing requests and queries raised to the controller
  • Inform about activities and events organised by the controller
  • Inform about products or services offered by the controller
  • Interact through official profiles

When the CONTROLLER collects and processes personal data through its social networks, the USERS will be informed about the purpose of the data collection, as well as their rights in relation to their personal data. Personal data will only be used for the indicated purposes and will be securely maintained.

Legal Basis for Processing: the explicit consent given by the USER for the processing of their personal data for one or several specific purposes (Article 6.1.a GDPR).

On the other hand, the USER may access at any time the privacy policies of the social network itself, as well as configure their profile to ensure their privacy.

How long will we keep your personal data?

Data retention criteria: data will be retained as long as the USER does not revoke the consent given as indicated in this privacy policy.

To whom do we provide your personal data?

Data communication: the information provided by the USER through the CONTROLLER’s social networks, including their personal data, may be published, always depending on the services that the USER uses, so it can be publicly available to other third-party users of social networks. From the profile of each social network, the USER can configure what information they want to make public in each case, see the permissions that have been granted, delete them or deactivate them, like any third-party application that is no longer wanted to be used.

However, no communication of personal data to third parties outside the social network is planned, except, if it is essential for the development and execution of the purposes of processing, to our service providers related to communications, with which the CONTROLLER has signed the confidentiality agreements and data processor contracts required by the current privacy regulations.

What are your rights?

Rights of the USER: they can only be satisfied in relation to that information that is under the control of the CONTROLLER.

  • Right to withdraw consent at any time.
  • Right of access, rectification, portability and deletion of their data, and of limitation or opposition to their processing.
  • Right to file a complaint with the control authority (www.aepd.es) if they consider that the processing does not comply with current regulations.

2. USE OF THE PROFILE

The CONTROLLER will carry out the following actions:

  • Access to public profile information.
  • Publication in the USER’s profile of all that information already published in the social network of the CONTROLLER.
  • Sending personal and individual messages through the social network channels.
  • Status updates of the page that will be published in the USER’s profile.

The USER can always control their connections, delete the contents that no longer interest them and restrict with whom they share their connections; for this, they must access their settings where they will find different configuration possibilities in relation to the degree of privacy of the user’s profile in the social network.

3. PUBLICATIONS

The purpose of social networks is to give visibility and dissemination to the activities carried out by the CONTROLLER. These tools store personal data on the respective services’ servers and are governed by their own privacy policy.

The USER, once a follower or having joined the social network of the CONTROLLER, may publish comments, links, images, photographs or any other type of multimedia content supported by the same on it. The USER, in all cases, must be the owner of the content published, enjoy copyright and intellectual property rights, or have the consent of the third parties affected.

The publication of any content on the social network, whether texts, graphics, photographs, videos, etc., that infringe or are likely to infringe morality, ethics, good taste or decorum, and/or that infringe, violate or breach intellectual or industrial property rights, the right to the image or the Law is expressly

prohibited. No offensive, defamatory, illegal or inappropriate comments or content will be tolerated on the company’s profiles. The Company reserves the right to remove such comments or content and block the responsible users.

In these cases, the CONTROLLER reserves the right to immediately withdraw the content, without prior communication, and may request the permanent blocking of the USER.

The CONTROLLER will not be responsible for the content that the USER has freely published.

The USER must be aware that their publications will be known by other users, so they are the main responsible for their privacy.

The images that may be published on the social network will not be stored in any file by the CONTROLLER, but they will remain on the social network.

4. DATA OF MINORS OR PEOPLE WITH SPECIAL CAPACITIES

It is recommended to review and read the terms of use and privacy policy of each social network at the time of registration, taking into account the different age requirements for doing so.

Likewise, the CONTROLLER is expressly exempted from any liability that may arise from the use of social networks by minors or people with special capacities and whose access should be carried out under the supervision and control of their legal representatives.

The CONTROLLER reserves the right to modify this policy at any time. Changes will be communicated through our social network profiles and/or our website.
